DUI Procedures in Eastern Washington State

If you have been pulled over for drunk driving, you must know your rights. You must protect yourself from the penalties of the criminal charge and the possible administrative suspension of your license. In Washington or Idaho, anyone who refuses a breath test or blood test, or whose blood alcohol content (BAC) is over .08 may face an automatic suspension of his or her license unless he or she requests a hearing from the Department of Licensing.

Your license may be suspended from 90 days to five years, depending on the circumstances of your case.

You must request a hearing very quickly after your DUI to protect your license. Washington currently requires you to have a "hearing request form" postmarked within twenty (20) days of your offense in order to have a hearing which may save your license. The hearing request form should have been provided to you by the officer who arrested you. Read this form carefully. Idaho requires a request be made in writing to the Dept. of Motor Vehicles within seven (7) days of the arrest. The rules and regulations regarding these, and other requirements, change frequently. You should contact an experienced DUI attorney to assist you in this process.

DUI Procedure and Deferred Prosecution

If you have been charged with a DUI/DWI, you may be able to either plead to a reduced charge such as reckless driving, negligent driving or infraction, or enter into deferred prosecution. Under the deferred prosecution option, if you are diagnosed as alcohol dependent and enter into treatment, you may be able to have your charges dismissed after five years. If the evidence against you is weak or if the police did not follow proper procedures, the attorneys at Andersen Staab P.L.L.C. will push for a dismissal of charges, suppression of evidence, or an acquittal at trial.
